It seems silly to me that they are not going to send convicts to prison because they have run out of space. That is ridiculous! Space is infinite! You can fit loads of prisoners out in space- in fact that seems like a very good place for them to go. And, if the universe is ever expanding, then there will be an ever increasing supply of prison space up there.
Problem solved.
